		<official-title>To amend the Rural Electrification Act of 1936 to
		  establish a grant program within the rural broadband program of the Department
		  of Agriculture, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Broadband Connections for Rural
			 Opportunities Program Act of 2012 </short-title></quote> or the
			 <quote><short-title>B-CROP Act of
			 2012</short-title></quote>.</text>
		</section><section id="idbbd3071d2fc7402087b1b15a5eee4c18"><enum>2.</enum><header>Broadband
			 connections for rural opportunities program</header><text display-inline="no-display-inline">Title VI of the Rural Electrification Act of
			 1936 (7 U.S.C. 950bb et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id30dad1c035814a2187cecd21d982834a" style="OLC">
				<section id="id66e46c6a094d4169b3672de1449b0de5"><enum>603.</enum><header>Broadband
				connections for rural opportunities program</header>
					<subsection id="id6b1d74ca19b74244bdcea76fb94a8a0d"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="id2f02600bb04346f0a7e7a3c829a2f16a"><enum>(1)</enum><header>Broadband
				service</header><text>The term <term>broadband service</term> has the meaning
				given the term in section 601(b).</text>
						</paragraph><paragraph id="id99cfc09e2ca84d21b5df80dd7b240cff"><enum>(2)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means an entity that
				is—</text>
							<subparagraph id="id3bdfacd8da8d4c95adcee1944d98b2a8"><enum>(A)</enum><text>a private sector
				provider of broadband telecommunications services; or</text>
							</subparagraph><subparagraph id="id3cc7ce43da88490f87332e2c35787d91"><enum>(B)</enum><text>a State, local,
				or tribal government, municipal provider, cooperative, institution of higher
				education, nonprofit organization, or public economic development
				organization.</text>
							</subparagraph></paragraph><paragraph id="idc81431b8cc454795b10bd4cf4af2f9b7"><enum>(3)</enum><header>Eligible rural
				community</header><text>Unless the Secretary makes a finding in writing that an
				area is otherwise <quote>rural in character</quote>, the term <term>eligible
				rural community</term> means any area of the United States that is not—</text>
							<subparagraph id="id5f493cda1b3e42cab25a5eab1721388a"><enum>(A)</enum><text>included within
				the boundaries of any incorporated city, village, borough, or town with a
				population in excess of 50,000 inhabitants; or</text>
							</subparagraph><subparagraph id="id7D5B4CB0539F49F1BC2E22DD4A774895"><enum>(B)</enum><text>the urbanized
				area contiguous and adjacent to a city, village, borough, or town described in
				subparagraph (A), as defined by the Bureau of the Census using the latest
				available decennial census of the United States.</text>
							</subparagraph></paragraph></subsection><subsection id="id52146375b79944f9b245837a6edaaa66"><enum>(b)</enum><header>Purposes</header><text>The
				purposes of the grant program under this section are—</text>
						<paragraph id="idf67e289999994ae2aa5b9f4e20c5f71d"><enum>(1)</enum><text>to enhance the
				feasibility of providing broadband service to eligible rural communities;
				and</text>
						</paragraph><paragraph id="id564f912008ed4bb08b37755aaa9b005a"><enum>(2)</enum><text>to deploy
				broadband telecommunications networks and capabilities to areas in which there
				is not otherwise a business case for private investment in a broadband network,
				with a focus on unserved eligible rural communities.</text>
						</paragraph></subsection><subsection id="id8289f2d0d88b42f6b99cf92f52206226"><enum>(c)</enum><header>Grants
				authorized</header>
						<paragraph id="idF413C33D08674358A1C6894E620C8221"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall award grants to eligible entities for
				deployment, identification, or adoption of broadband services within eligible
				rural communities.</text>
						</paragraph><paragraph id="idB5F3D7C1331C4537860FC7D4371A7073"><enum>(2)</enum><header>Amount</header><text>A
				grant awarded to an eligible entity under this section may not be made in
				excess of 50 percent of the eligible project development costs.</text>
						</paragraph></subsection><subsection id="id6d71703915ab49708a2e75b116f100d1"><enum>(d)</enum><header>Application</header><text>To
				be eligible to receive a grant under this section, an eligible entity shall
				submit an application to the Secretary at such time, in such manner, and
				containing such information as the Secretary may require.</text>
					</subsection><subsection id="id13e2178d06d8428f9dc8e76c9898ac3a"><enum>(e)</enum><header>Use of
				funds</header><text>A grant awarded to an eligible entity under this section
				shall be—</text>
						<paragraph id="id25A3EE9346054AB89E563979D6568F7F"><enum>(1)</enum><text>used to
				facilitate the deployment of broadband telecommunications networks and
				capabilities to areas in which there is not otherwise a business case for
				private investment in a broadband network, with a focus on unserved eligible
				rural communities; or</text>
						</paragraph><paragraph id="idd3405f5dc606466390f6f7d56df3e3ec"><enum>(2)</enum><text>combined with
				loans to enhance economic feasibility of projects serving high cost areas in
				which there is not otherwise a business case for private investment in a
				broadband network, with a focus on unserved eligible rural communities.</text>
						</paragraph></subsection><subsection id="id56A98AB1A0784D839E808FB32F89EE50"><enum>(f)</enum><header>Priority</header><text>In
				awarding grants under this section, the Secretary shall give priority to
				project applications that—</text>
						<paragraph id="id694dbaed77f94e4083115fc0109741fe"><enum>(1)</enum><text>as a percentage
				of the total applications, provide service to the highest proportion of rural
				residents that do not have access to broadband service;</text>
						</paragraph><paragraph id="id0ba59f4c7508482fbfe68707c1600fc6"><enum>(2)</enum><text>will use
				broadband services to stimulate rural economic development, such as
				providing—</text>
							<subparagraph id="id9183e712d790432e80f91c396076159f"><enum>(A)</enum><text>connections
				between and among businesses and business incubators located in eligible rural
				communities; and</text>
							</subparagraph><subparagraph id="id36827af325364394adfba2dae027e1d3"><enum>(B)</enum><text>connections that
				are integrated with county and regional organization plans.</text>
							</subparagraph></paragraph></subsection><subsection id="idf5bc77f00bfa4a51b653cfced8e7e376"><enum>(g)</enum><header>Processing
				period</header>
						<paragraph id="idDBE30480849F49F1BDB3977850895099"><enum>(1)</enum><header>In
				general</header><text>Not later than 180 days after the date on which funds are
				appropriated to carry out this section, the Secretary shall publish a notice of
				funds availability.</text>
						</paragraph><paragraph id="idC6B69B71D95E4D8980296E85A23D7685"><enum>(2)</enum><header>Awards</header><text>Not
				later than the end of the fiscal year following the date on which a notice is
				published under paragraph (1), the Secretary shall announce grant awards under
				this section.</text>
						</paragraph></subsection><subsection id="idc5ada6ece9b44e86ad4f16449689fc08"><enum>(h)</enum><header>Report</header>
						<paragraph id="iddd36ad20296c4b01942c88e64a96ff79"><enum>(1)</enum><header>In
				general</header><text>Each recipient of a grant under this section shall submit
				to the Secretary a report describing the use of the funds provided by the
				grant.</text>
						</paragraph><paragraph id="idf1670d96cf8742bc8de27018c8ece3dc"><enum>(2)</enum><header>Secretarial
				report</header><text>Not later than 180 days after the date of enactment of
				this Act, and biannually thereafter until all funds are obligated, the
				Secretary shall submit a report to the Committees on Appropriations of the
				House of Representatives and the Senate that describes planned spending and
				actual obligations of the funds made available to carry out this
				section.</text>
						</paragraph></subsection><subsection id="idb57264fbc6b24743985036b88c6958bb"><enum>(i)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section such sums as are necessary for each of fiscal years 2012
				through
				2014.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id34186dd3f47d46b2b43daad837a7dc3f"><enum>3.</enum><header>Improving the
			 application process for the rural broadband program</header>
			<subsection id="id40c37993e9a845f692639d81742110b3"><enum>(a)</enum><header>In
			 general</header><text>Section 601 of the Rural Electrification Act of 1936 (7
			 U.S.C. 950bb) is amended—</text>
				<paragraph id="ide42f76dd387146d3937f525eac9464ad"><enum>(1)</enum><text>in subsection
			 (c), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7ac53253336143bb9d8c8b3e4621e0fa" style="OLC">
						<paragraph id="id0d3240967871468394acb340d36fe01b"><enum>(3)</enum><header>Paperwork
				reduction</header><text>The Secretary shall take such steps as are necessary to
				reduce the paperwork required of applicants under this section.</text>
						</paragraph><paragraph id="id6E0E014A669F4CE5A765D590CD9A27EF"><enum>(4)</enum><header>Processing
				period</header>
							<subparagraph id="idB168A12909A7419B8DE103ED5504D7C8"><enum>(A)</enum><header>In
				general</header><text>Not later than 180 days after the date on which funds are
				appropriated to carry out this section, the Secretary shall publish a notice of
				funds availability.</text>
							</subparagraph><subparagraph id="id9E6844270CA942B39401D6739B64DED2"><enum>(B)</enum><header>Awards</header><text>Not
				later than the end of the end of the fiscal year following the date on which a
				notice is published under subparagraph (A), the Secretary shall announce grant
				awards under this
				section.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id473e085e37d74939b73c935ddabbafff"><enum>(2)</enum><text>by redesignating
			 subsections (i) through (l) as subsections (k) through (n), respectively;
			 and</text>
				</paragraph><paragraph id="id7200d073199c41e0aee849395b66fa88"><enum>(3)</enum><text>by inserting
			 after subsection (h) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7d054910e0a1416b9a3504b0ef957402" style="OLC">
						<subsection id="idc08ef69a7a184300a42aff5b89cd8176"><enum>(i)</enum><header>Outreach</header><text>The
				Secretary shall conduct outreach designed to inform the population of areas in
				which there is no or limited broadband service of the program carried out under
				this section.</text>
						</subsection><subsection id="idbbdc16b920774ade948a54ac6a33b1df"><enum>(j)</enum><header>Additional
				staff</header><text>The Secretary, in the discretion of the Secretary, may use
				up to 20 percent of the budget authority appropriated to carry out this section
				to hire such additional administrative personnel, including general field
				representatives and legal staff, as are necessary to carry out the
				administrative duties under this
				section.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id6024938143fe4f2992a5bd0819527e99"><enum>(b)</enum><header>Simplification
			 of the application process and post-Application audit requirements</header>
				<paragraph id="idac8494d8448f4086b0ef3fa5039766e9"><enum>(1)</enum><header>Definition of
			 subsidiary</header><text>In this subsection, the term <term>subsidiary</term>
			 means a business entity controlled, directly or indirectly, by another business
			 entity or person.</text>
				</paragraph><paragraph id="idc88f5387bd114529ba08359802e6f17c"><enum>(2)</enum><header>Requirements</header><text>In
			 carrying out title VI of the Rural Electrification Act of 1936 (7 U.S.C. 950bb
			 et seq.), the Secretary of Agriculture, in consultation with the Administrator
			 of the Rural Utilities Service, shall, to the maximum extent
			 practicable—</text>
					<subparagraph id="id01e88207446d497096978742409c43c8"><enum>(A)</enum><text>remove any
			 duplicative or unnecessary application or audit requirements under that
			 title;</text>
					</subparagraph><subparagraph id="idf61e85659c434ea3a965d5ddf9a6a8ac"><enum>(B)</enum><text>reduce the cost
			 and paperwork associated with the application and audit requirements, including
			 allowing parent companies, and the wholly owned subsidiaries of parent
			 companies, to file a single consolidated application or audit report, if the
			 application or report includes all relevant financial information concerning
			 the project that is the subject of the grant, loan, or loan guarantee;</text>
					</subparagraph><subparagraph id="id848fdb70902c404ab156ba15f2a74297"><enum>(C)</enum><text>ensure that the
			 Secretary examines—</text>
						<clause id="id1422F4AA67994B2FB5848B3EF98536C6"><enum>(i)</enum><text>the
			 total business plan of each applicant for a grant, loan, or loan guarantee
			 under that title, including the revenue the applicant generated from sources
			 unrelated to the broadband service of the applicant, but connected or otherwise
			 related to the facilities financed by the grant, loan, or loan guarantee;
			 and</text>
						</clause><clause id="id4216D44051F340C28D22A3E9770F9BB4"><enum>(ii)</enum><text>the requested
			 information and projections provided by each applicant to ensure that there is
			 no conflict with the regulatory obligations of the applicant to other Federal
			 agencies including, at a minimum, to the Securities and Exchange Commission,
			 the Federal Communications Commission, and the Federal Trade Commission;
			 and</text>
						</clause></subparagraph><subparagraph id="ida221ae8619db4e50b586e8a3a9778d70"><enum>(D)</enum><text>require that any
			 recipient of a grant, loan, or loan guarantee under that title uses the funds
			 from the grant, loan, or loan guarantee not later than 5 years after date of
			 receipt of the funds to complete the project for which the funds were approved,
			 unless the Secretary determines that the recipient was unable to expend the
			 funds due to circumstances beyond the control of the recipient.</text>
					</subparagraph></paragraph></subsection></section><section id="id25646f4813304fcf9225a880a13c74b4"><enum>4.</enum><header>Rural broadband
			 program coordination</header><text display-inline="no-display-inline">Title VI
			 of the Rural Electrification Act of 1936 (7 U.S.C. 950bb et seq.) (as amended
			 by section 3) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id58f7697a95f3493ebb3bfeabc524f4b4" style="OLC">
				<section id="id38e499e13b794d6f8ec575bf359fdaa2"><enum>604.</enum><header>Clearinghouse
				website</header><text display-inline="no-display-inline">The Secretary may use
				up to 5 percent of the budget authority made available to carry out this
				section for a national competition to create and maintain a comprehensive and
				interactive rural broadband clearinghouse accessible on the Internet at no cost
				to the public that describes options, opportunities, resources, successful
				public-private partnerships, comprehensive funding sources, and technology
				tutorials for rural broadband, including—</text>
					<paragraph id="ida19260b783b049818f617f35f3118f58"><enum>(1)</enum><text>case
				studies;</text>
					</paragraph><paragraph id="id342cd81a2e894280b672c3584a1c0666"><enum>(2)</enum><text>descriptions of
				best practices;</text>
					</paragraph><paragraph id="idbff5ced8da0c45e4a2617aafe7fd6638"><enum>(3)</enum><text>assessments of
				various technology solutions;</text>
					</paragraph><paragraph id="id8424638e9d2c4b65a906a6ba94d44472"><enum>(4)</enum><text>feasibility
				studies;</text>
					</paragraph><paragraph id="id7a97c968dfa545399de11c1dafedf6f2"><enum>(5)</enum><text>applications,
				including telework, telemedicine, distance learning, training, homeland
				security, senior citizen connectivity and program development, and business and
				economic development;</text>
					</paragraph><paragraph id="id8fba979f07824053a4b0281b946e1d4c"><enum>(6)</enum><text>rural broadband
				options and policies analysis;</text>
					</paragraph><paragraph id="id7fc7540d5ad8490d8c73233ac9b9a2ef"><enum>(7)</enum><text>support for
				networks among rural communities and economic development agencies; and</text>
					</paragraph><paragraph id="id8f21d9e295f840aba90e5a16e1ca108f"><enum>(8)</enum><text>a comprehensive
				list of municipal, nonprofit, and private sector providers.</text>
					</paragraph></section><section id="id01bcac9b508944cfb5c6ac4d8188ffed"><enum>605.</enum><header>Report to
				Congress</header><text display-inline="no-display-inline">Not later than 540
				days after the date of enactment of this section and subsequently not later
				than the date that is 3 years after the date of the submission of initial
				report, the Comptroller General of the United States shall submit to the
				Committee on Agriculture of the House of Representatives and the Committee on
				Agriculture, Nutrition, and Forestry of the Senate a report that
				includes—</text>
					<paragraph id="id18263c31571f4b6697e96db1296ec3e3"><enum>(1)</enum><text>an evaluation of
				the effectiveness of all Federal broadband assistance programs and policies
				aimed at fostering broadband access in rural and unserved areas, such as
				identifying and tracking—</text>
						<subparagraph id="id19a896c52add44a69a58f32db6015473"><enum>(A)</enum><text>rural areas in
				each State that do not have broadband service;</text>
						</subparagraph><subparagraph id="idc11908c4b6d840b290d5e8e34d5aa2a8"><enum>(B)</enum><text>the rate at which
				residential and business end users adopt broadband service when infrastructure
				is made available;</text>
						</subparagraph><subparagraph id="id3ab6fb55da814ee3ba7ec74756aa95fb"><enum>(C)</enum><text>possible
				suppliers of broadband service;</text>
						</subparagraph><subparagraph id="id8a598f41bc094e98b81619d7341e1302"><enum>(D)</enum><text>the speed of
				broadband service offered in rural areas that do have access;</text>
						</subparagraph><subparagraph id="idfd2d8ce2c5c64cea90adc12ee0de1d85"><enum>(E)</enum><text>barriers to the
				adoption of broadband service, including whether—</text>
							<clause id="id6c3fbb99b2c14bccaabb29053e321f07"><enum>(i)</enum><text>the demand for
				broadband service is absent; and</text>
							</clause><clause id="id0ba97fa3f9684baaa336a295af77e47d"><enum>(ii)</enum><text>the supply for
				broadband service is capable of meeting the demand for the service;</text>
							</clause></subparagraph><subparagraph id="ida585bcfa24054e8c8d8a7e37ee1ef452"><enum>(F)</enum><text>proposals for
				promoting interagency coordination of Federal agencies in regards to policies,
				procedures, and targeted resources, and means to improve and streamline the
				policies, programs and services; and</text>
						</subparagraph><subparagraph id="id7830EB513FE04BDD8166B89223BD31BF"><enum>(G)</enum><text>the adequacy of
				Federal and State universal service support programs and policies;</text>
						</subparagraph></paragraph><paragraph id="id24edd8c585ba40df8b4f9e62fce23758"><enum>(2)</enum><text>an assessment of
				best practices employed at the State and local government level to foster
				broadband access in rural and underserved areas; and</text>
					</paragraph><paragraph id="ide86472346d904d04b35eca6eda4b7aef"><enum>(3)</enum><text>an evaluation of
				methods to coordinate and harmonize, to the maximum extent practicable, the
				efforts of the Department of Agriculture, the Department of Commerce, and the
				Federal Communications Commission to advance broadband deployment in rural
				areas throughout the United
				States.</text>
					</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
